Terms of Use

Please read these Terms of Use carefully before accessing or using any part of the Layertrack platform available at layertrack.sbs. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
Platform refers to the website, services, tools, and educational content made available by Layertrack at layertrack.sbs and any associated subLayertracks.
User refers to any individual or entity that accesses or uses the Platform, whether or not registered.
Account refers to a registered profile created by a User to access restricted features of the Platform.
Content refers to all text, video, audio, graphics, data, course materials, assessments, and any other materials available through the Platform.
We, Us, Our refers to Layertrack, the operator of the Platform.
2. Acceptance of Terms
By creating an Account, completing a registration form, clicking an acceptance button, or otherwise using the Platform, you enter into a binding agreement with Layertrack under these Terms of Use together with our Privacy Policy, which is incorporated herein by reference.
If you are using the Platform on behalf of an organization or business, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" include that entity.
2. Eligibility
You must be at least 16 years of age to use the Platform independently. Users under the age of majority in their jurisdiction must have the consent and supervision of a parent or legal guardian. By using the Platform, you represent that you meet these eligibility requirements.
We reserve the right to refuse access to any User who does not satisfy eligibility criteria or who has previously been suspended or removed from the Platform.
3. Account Registration and Security
3.1 Registration
Certain features of the Platform require you to create an Account. When registering, you agree to provide accurate, current, and complete information and to update that information as necessary to keep it accurate.
3.2 Credentials
You are responsible for maintaining the confidentiality of your login credentials. You must not share your password with any third party. You agree to notify us immediately at support@layertrack.sbs if you become aware of any unauthorised access to your Account.
3.3 Responsibility
You are solely responsible for all activity that occurs under your Account. We are not liable for any loss or damage arising from your failure to maintain the security of your credentials.
4. Permitted Use
The Platform is provided for lawful, personal, and non-commercial educational purposes unless a separate written agreement with Layertrack expressly grants commercial or organisational use rights.
You agree to use the Platform only in a manner consistent with these Terms and all applicable laws and regulations. You must not:
— Access or attempt to access areas of the Platform that are not intended for general access.
— Use automated tools, bots, scrapers, or crawlers to extract Content or data from the Platform without prior written consent.
— Circumvent, disable, or interfere with any security-related features of the Platform.
— Upload, transmit, or distribute any content that is unlawful, defamatory, obscene, fraudulent, or harmful.
— Attempt to gain unauthorised access to any server, database, or network connected to the Platform.
— Use the Platform to send unsolicited communications or advertising of any kind.
— Impersonate any person or entity or misrepresent your affiliation with any person or entity.
5. Intellectual Property
5.1 Ownership
All Content on the Platform, including but not limited to course materials, lecture recordings, written materials, graphics, software, and trade marks, is the property of Layertrack or its licensors and is protected by applicable intellectual property laws.
5.2 Limited Licence
Subject to your compliance with these Terms, Layertrack grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal, non-commercial educational purposes.
5.3 Restrictions
You may not reproduce, distribute, publicly display, modify, create derivative works from, sell, or exploit any Content without the prior written permission of Layertrack. Downloading or saving Content is permitted only where an explicit download option is provided by the Platform.
3.4 User Submissions
If you submit any content to the Platform, including comments, forum posts, or assignments, you grant Layertrack a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display that content for the purpose of operating and improving the Platform. You represent that you own or have the necessary rights to make such a submission.
6. Payments and Subscriptions
6.1 Fees
Access to certain courses or features may require payment. All applicable fees are displayed on the Platform prior to purchase. Prices are shown in the currency relevant to your region and may include applicable taxes.
6.2 Billing
By providing payment information, you authorise Layertrack or its payment processors to charge the applicable fees. You are responsible for ensuring that your payment information is accurate and up to date.
6.3 Refunds
Refund eligibility is governed by our Refund Policy, which is available on the Platform. Unless otherwise stated, fees paid are non-refundable once access to paid Content has been granted.
6.4 Changes to Fees
Layertrack reserves the right to change pricing at any time. Changes to fees for active subscriptions will be communicated with reasonable advance notice and will not apply until the next billing cycle.
7. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Layertrack does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
Educational Content is provided for informational purposes only. Layertrack does not guarantee that completion of any course or programme will result in any particular professional outcome, qualification, or employment result.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Layertrack and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, even if Layertrack has been advised of the possibility of such damages.
In no event shall Layertrack's total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform exceed the greater of the total fees paid by you to Layertrack in the twelve months preceding the claim or one hundred Canadian dollars (CAD 100).
9. Third-Party Services and Links
The Platform may contain links to third-party websites or integrate with third-party services. These links and integrations are provided for convenience only. Layertrack does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described in the Privacy Policy.
11. Termination
11.1 By You
You may terminate your Account at any time by contacting us at support@layertrack.sbs or through the account settings on the Platform. Termination does not entitle you to a refund unless otherwise required under the Refund Policy.
11.2 By Layertrack
We reserve the right to suspend or terminate your Account and access to the Platform at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or otherwise acted in a manner harmful to other Users or to Layertrack.
11.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination, including intellectual property rights, disclaimers, and limitations of liability, shall continue to apply.
12. Modifications to the Terms
Layertrack reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Where changes are material, we will make reasonable efforts to notify registered Users through the Platform or by email. Continued use of the Platform after any such changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed of any updates.
13. Governing Principles and Dispute Resolution
These Terms shall be construed and governed in accordance with general principles of commercial contract law without giving effect to any choice-of-law provisions that would require the application of any particular jurisdiction's laws.
In the event of a dispute arising out of or in connection with these Terms, the parties agree to attempt to resolve the matter through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration or an alternative dispute resolution mechanism agreed upon in writing by both parties.
14. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented at the point of purchase or registration, constitute the entire agreement between you and Layertrack with respect to your use of the Platform and supersede all prior agreements and understandings relating to the same subject matter.
